Privacy Policy

Effective September 28, 2026 · Last updated September 28, 2026 · Authored by Michael Bass, Owner, True Day Water Damage Restoration · Utah Contractor License #960332-3505

What This Policy Covers

This is True Day’s privacy policy. It explains what information we collect from homeowners, insurance carriers, and website visitors; how we use that information; how long we keep it; who else can see it; and what rights you have to review, correct, or delete it.

The policy is written in plain language because privacy policies that require a lawyer to interpret are not real disclosures — they are compliance theater. If any part of this is unclear, call Michael directly at (385) 247-9359 or email info@truedaywaterdamagerestoration.xyz and ask.

Who We Are

True Day Water Damage Restoration is a Utah-licensed contracting business (License #960332-3505), owned and operated by Michael Bass. Our office is at 11268 S 2865 W, South Jordan, UT 84095. We are the sole data controller for the information described on this page — we do not sell, share, or transfer homeowner data to lead-generation brokers, marketing companies, or data resellers.

What We Collect and Why

Information You Provide Directly

When you call, email, or submit a form, you provide us with your name, phone number, email address, service address, and a description of the water damage or restoration issue. This is the minimum information required to dispatch a technician and prepare an Xactimate scope. We do not ask for social security numbers, credit card numbers over the phone, or any information not directly necessary for the service.

Phone Call Recordings

Incoming calls to (385) 247-9359 are recorded for quality assurance and training purposes. Utah is a one-party consent state, meaning only one party to a call needs to consent to recording; by continuing a call after this policy is available on our website and disclosed on our voicemail greeting, you consent to that recording. Recordings are stored securely and reviewed only for training, dispute resolution, and quality purposes. You may request that your specific call recording not be retained by asking the technician on the line or emailing us within 30 days of the call.

Job Site Photos and Video

During restoration projects, True Day technicians take photographs and occasional video for three purposes: (1) documenting damage for insurance carrier Xactimate submissions, (2) verifying drying progress and completion, and (3) building a project record we retain for warranty and warranty-dispute purposes. Photos may include the interior of your home, damaged materials, equipment placement, and moisture readings on visible walls or floors.

We do not photograph personal belongings, family photographs, mail, documents on visible surfaces, or areas of the home unrelated to the restoration work. If any personal item is inadvertently visible in a documentation photograph, we redact it before the photo is used for any purpose beyond the insurance submission and warranty file.

We may use anonymized job site photographs (with faces, addresses, license plates, house numbers, and identifying personal effects removed or blurred) on our website, social media, and educational materials. If you do not want photographs from your project used in this way, tell the technician on-site or email us within 30 days of project completion — we will flag your project file as “no external use” and only use photos internally.

Insurance Carrier Correspondence

Water damage restoration is typically insurance-billed, which means True Day submits scopes, invoices, and supporting documentation to your homeowners insurance carrier. This correspondence includes your name, address, policy number (if you provide it), Xactimate scope details, photos, and moisture readings. We share this with your carrier because that is how the claim is processed — we do not share it with any third party beyond the carrier and their assigned adjusters or independent adjusters.

Website Activity

Our website uses standard web analytics (Google Analytics) to understand how visitors find and use our site. This tracks pages viewed, time on page, general geographic location (city-level), device type, and referring source. It does not track your name, address, or any personal identifier unless you submit a form. You can opt out of Google Analytics tracking through your browser’s do-not-track settings or by installing Google’s opt-out browser add-on.

Cookies

Our website uses cookies for basic session management, analytics, and to remember your form entries if you navigate between pages. We do not use third-party advertising cookies, retargeting cookies, or cross-site tracking pixels. You can disable cookies in your browser settings; some parts of our site may function less smoothly, but you can still use them.

SMS and Text Messaging

True Day does not use SMS or text messaging for marketing purposes. We may send transactional text messages to confirm an appointment, notify you of a technician’s estimated arrival, or communicate about an active project — but only if you have provided your mobile number to us and only for the specific project. We do not enroll you in marketing text lists, promotional campaigns, or any messaging beyond the immediate service.

If you receive a text message that appears to be from True Day and you did not authorize it, reply STOP or contact us at (385) 247-9359 immediately. It may be a phishing message using our name.

Who Else Sees Your Data

The complete list of parties with whom True Day may share your information:

  • Your homeowners insurance carrier and their adjusters — for claim processing purposes only. This is the only sharing that happens by default.
  • Our accounting service — for invoicing and financial record purposes. They receive invoice-level data (amount, project ID) but not photos or narrative details.
  • Our payment processor — when you pay a deductible or non-insurance portion. They receive transaction data per standard PCI-DSS practices; we do not retain your full card number.
  • Law enforcement, if legally required — in response to a valid subpoena, court order, or lawful investigation. We will attempt to notify you before responding unless legally prohibited from doing so.

We do not share, sell, rent, or transfer your data to marketing companies, lead brokers, data resellers, insurance-adjacent marketing services, home services aggregators, or any third party outside the list above.

How Long We Keep Your Data

True Day retains project files, photographs, insurance correspondence, and inspection reports indefinitely unless you request deletion. We retain data long-term because water damage claims sometimes surface delayed issues (mold behind walls, foundation shifts, latent structural concerns), and having the original project file available protects both the homeowner and True Day if a warranty question arises years later.

You have the right to request deletion of your data at any time by emailing info@truedaywaterdamagerestoration.xyz or calling (385) 247-9359. We will delete your file within 30 days of request, with these exceptions:

  • We retain financial records (invoices, payment records) for 7 years per IRS and Utah state requirements.
  • We retain records under active insurance-claim or legal dispute until the matter is resolved.
  • Anonymized photographs already published on our website or social media prior to your deletion request are not automatically removed — but we will remove specific photographs on request within 14 days.

Call recordings are retained for 24 months and then automatically deleted unless flagged for a specific quality or dispute purpose.

Your Rights

Regardless of your state of residence, True Day extends the following rights to every homeowner:

  • Right to access: Request a copy of the data we hold about you and your project. We provide this within 30 days at no cost.
  • Right to correct: If any information we hold is inaccurate, tell us and we will correct it within 14 days.
  • Right to delete: Request deletion of your data (with the exceptions noted above).
  • Right to know who has seen your data: Ask for a list of every party your data has been shared with; we provide this within 30 days.
  • Right to opt out of anonymized photo use: Even after project completion.
  • Right to withdraw call-recording retention: Ask us not to retain a specific call recording.

Utah does not currently have a comprehensive consumer privacy statute equivalent to California’s CCPA/CPRA or the EU’s GDPR, but True Day applies these rights to every homeowner regardless of residence.

Data Security

Homeowner data is stored on password-protected devices and in access-controlled cloud storage. Only Michael Bass and authorized True Day employees have access. Third-party services we use (accounting, payment processing, cloud storage) are selected based on their published security practices.

No system is fully secure, and we cannot guarantee that data will never be compromised. If a data breach occurs that affects your personal information, we will notify you within 72 hours of confirming the breach, as required by evolving state and federal notification standards.

Children’s Privacy

Our services are directed at homeowners, not children. We do not knowingly collect information from anyone under 18. If you believe we have inadvertently collected such information, contact us and we will delete it promptly.

Changes to This Policy

If we update this policy in a way that materially changes how we handle your data, we will post the revised version on this page and update the “Effective” date at the top. For homeowners with an active project or membership at the time of change, we will notify you by email of the change and its effect.

Questions or Complaints

Privacy questions, requests for access, correction, or deletion, and complaints about how we have handled your data all go to the same address:

Every message reaches Michael personally. If you feel your privacy concern was not adequately handled, you may also file a complaint with the Utah Division of Consumer Protection or the Federal Trade Commission.

Emergency calls and photo evidence — our data policy

Water-damage emergencies generate two kinds of homeowner data most people don’t think about until later: the recorded call and the photos of your home. Here is what we do with them and how to have them deleted.

Recorded calls

Incoming calls to (385) 247-9359 are recorded for quality and training. Utah is a one-party-consent state, meaning we are legally permitted to record a call we are a party to. The call recording includes the dispatcher’s intake conversation and may include your voice as you describe the loss.

Retention: 24 months from the date of the call. After 24 months the recording is deleted automatically. Call recordings are not shared with any third party, insurance carrier included, except where legally compelled by subpoena.

You can request that your call recording be deleted immediately, before the 24-month retention expires, by emailing or calling (385) 247-9359 and asking. We confirm deletion in writing within 5 business days.

Photo and documentation data

Timestamped job photos, moisture-reading logs, floor plans and scope documents are collected during every job. These are retained for the warranty period (2 years from closeout) so we can defend against any workmanship question that comes up, and to support any supplement your carrier might request.

Photos are shared only with: you, your insurance adjuster if you have an open claim, and the True Day crew working your job. We do not post identifiable photos of your home to any marketing surface — any case study or before/after photo used in marketing is either anonymized (no address, no identifying exterior) or published only with your explicit written consent.

You can request that your photo and documentation file be deleted at the end of the warranty period, or before, by emailing or calling us. Deletion is confirmed in writing within 5 business days.
